Platform Terms and Conditions

These Terms and Conditions govern your use of the eMedClinic platform. By accessing or using our platform, you agree to be bound by these terms. Please read them carefully before booking an appointment or registering as a contracted doctor.

eMedClinic is operated by Apogeu Proeminente Unipessoal Lda, registered in Portugal (NIF: 518240290), trading as eMedClinic.

1 About eMedClinic

eMedClinic is an online booking and payment marketplace that connects patients with independent, contracted medical professionals. eMedClinic facilitates the booking and payment process only. We are not a medical provider. Each doctor on our platform is an independent practitioner responsible for their own clinical decisions, diagnosis, and treatment.

2 Eligibility

You must be 18 years of age or older to book a consultation through eMedClinic. By completing a booking you confirm that you are 18 or over.

3 Booking and Payment

• All bookings are subject to doctor availability and confirmation
• Payment is required at the time of booking
• Prices are displayed inclusive of any applicable taxes
• Payment is processed securely via our payment provider. eMedClinic does not store card details

4 Cancellation and Refunds

• Cancellations made more than 24 hours before the appointment will receive a full refund
• Cancellations made within 24 hours of the appointment are non-refundable
• If a doctor cancels your appointment you will receive a full refund or the option to rebook
• Refunds will be processed within 5 to 10 business days

5 Medical Disclaimer

eMedClinic is not a medical provider. Consultations through our platform are provided by independent doctors and do not constitute emergency medical services. If you are experiencing a medical emergency please contact the emergency services immediately by calling 112.

The clinical relationship is solely between you and the contracted doctor. eMedClinic accepts no liability for the clinical decisions, advice, diagnosis or treatment provided by contracted doctors.

6 Patient Data

eMedClinic collects only the minimum data necessary to process your booking. We do not collect or store clinical data. Please refer to our Privacy Policy for full details of how we handle your personal data.

7 Platform Use

You agree to use the eMedClinic platform lawfully and in accordance with these terms. You must not misuse the platform, provide false information, or use the platform for any unlawful purpose.

8 Intellectual Property

All content on the eMedClinic platform including text, design, logos and branding is the property of Apogeu Proeminente Unipessoal Lda and may not be reproduced without written permission.

9 Limitation of Liability

To the fullest extent permitted by law, eMedClinic's liability in connection with the platform is limited to the value of the booking fee paid. We are not liable for any indirect, consequential or clinical loss arising from your use of the platform or from consultations conducted through it.

10 Governing Law

These terms are governed by Portuguese law. Any disputes arising from these terms shall be subject to the jurisdiction of the Portuguese courts.

11 Doctor Registration

By registering as a contracted doctor on eMedClinic you confirm and warrant that:

• You hold valid medical registration with the Ordem dos Médicos in Portugal, the Colegio de Médicos in Spain, or an equivalent EU member state professional body
• Your registration is current, active and in good standing
• You hold valid professional indemnity insurance covering online and telemedicine consultations
• You will notify eMedClinic immediately if your registration or insurance status changes

12 Nature of Relationship

Contracted doctors on the eMedClinic platform are independent practitioners. Nothing in these terms creates an employment, agency or partnership relationship between the doctor and eMedClinic. Each doctor is solely responsible for their own clinical practice, decisions, and compliance with applicable professional and regulatory obligations.

13 Patient Data and GDPR

Each contracted doctor is solely responsible for the collection, storage and processing of patient clinical data within their own practice management systems. Doctors must comply fully with GDPR and applicable data protection law in relation to any patient data they hold. eMedClinic does not hold or process patient clinical data.

14 Professional Standards

Each contracted doctor agrees to maintain the professional standards required by their relevant professional body, to conduct consultations in a professional and ethical manner, and to comply with all applicable healthcare regulatory requirements in the jurisdictions in which they practise.

15 Fees and Payment

Consultation fees are agreed between eMedClinic and each contracted doctor prior to the doctor going live on the platform. eMedClinic retains a platform fee per consultation. Fee structures are set out in the individual doctor onboarding terms accepted at registration.

16 Termination

eMedClinic reserves the right to remove a doctor from the platform at any time if they are found to be in breach of these terms, if their professional registration lapses, or if their conduct is deemed to be contrary to the standards expected of a contracted doctor on the platform.

17 Changes to These Terms

eMedClinic reserves the right to update these Terms and Conditions at any time. Continued use of the platform following notification of changes constitutes acceptance of the updated terms.
